    Waja Hostels is a platform owned by Waja for Tourist Facilities Management (Commercial Registration Number 1010875714) that provides access to and utilization of its services. This policy has been developed to protect and preserve the rights of both the platform and its users.

     

    1- Acceptance of Terms of Use:

    By accessing and using Waja Hostels platform, you acknowledge and agree, without any modification, restrictions, or substitutions to these Terms and Conditions, and any other policies governing the use of platform services. You also confirm your legal eligibility to enter into this agreement in accordance with all the terms and conditions contained herein. Therefore, you must read the terms and conditions each time you use the platform to ensure that you are aware of all the current terms and conditions. Accordingly, your continued use of the platform is considered your acceptance of any changes to the terms and conditions. If you do not accept the terms of use, you must refrain from using the platform or its services.

     

    2- Changes to the Agreement:

    1. The platform will update the "Last Updated" date at the top of this document, so you must visit this page regularly and before any transaction through the platform.

    2. This agreement is automatically terminated without the need for any legal, judicial action, or sending any notice or notification, in the event of your breach of any clause or paragraph of this agreement, or your violation of any financial or non-financial rights related to the platform, or the platform's inability to verify or complete your information, or the platform ceasing to provide or changing its services, or causing any legal problems or disputes for the platform.

    3. In the event of the termination of the agreement in accordance with the previous paragraph, this does not affect the legal consequences that arose from the execution of the agreement during its validity period, and these consequences remain binding on the user.

    4. We may make any update, change, or modification to the terms and conditions at any time and without prior notice. Any amendments to the terms and conditions become effective immediately upon publication and will not have any retroactive effect on prior transactions.

    5. Waja Hostels strives to provide information as accurately as possible. However, some errors may occur from time to time.

    6. Waja Hostels and any of our partners do not assume any responsibility for any errors in the information contained on the platform.

    7. The terms and conditions become effective upon publication on the platform and will not have any retroactive effect on any prior reservations made through it.

    This is a company registered in the Kingdom of Saudi Arabia with Commercial Registration Number 1010875714, headquartered in Riyadh, and it manages and operates the Waja Hostels platform.

    Waja Hostels Platform:

    An electronic intermediary for managing furnished housing units dedicated to short and long-term tourism through a cloud-based technological solution that facilitates an integrated, seamless, and competitive operation, with innovative and reality-reflecting images, in addition to virtual unit photography services.

    3

    User:

    The real or legal person who accesses or uses the platform to benefit from the services provided through the platform, whether registered or not. They are collectively referred to as "Users" in this agreement.

    4

    Website:

    Refers to the web pages and the platform owned by it.

    5

    Account:

    This refers to the user's account on the platform through which they can access platform services.

    6

    Owner or Lessor:

    This refers to the legal entity (legal or natural person) that lists its units through the platform for rent or sale.

    7

    Intermediary:

    This refers to the legal entity (legal or natural person) that manages the presentation, reservation, and sale of units to its clients through the platform.

    Owner Information:

    Refers to the information provided by the owner or lessor with the purpose of listing it on the platform. This includes photos, photographic images, descriptions, guarantees provided, units available for booking, price details, availability, cancellation policies, deposits, and other policies and restrictions.

    Payment Facilities:

    These refer to the payment methods that the platform may make available from time to time in certain jurisdictions on the platform for the payment of the unit price by customers (either in advance or a down payment) to the platform. Accordingly, bank transfers, credit card payments, or any other form of online payment can be processed on behalf of the owner or developer.

    Force Majeure Conditions:

    These refer to any of the following events that affect many customers and listed units: acts of God, volcanic eruptions, natural disasters, fires, acts of war, hostile acts, any local or national state of emergency, invasions, compliance with any order or request of any local authority, county authority, port authority, or any other public authority, government regulation or government intervention, military action, civil war, acts of terrorism, explosions, rebellions, riots, civil disturbances, reduction in transportation facilities, airport closures, or any other extraordinary or catastrophic event or emergency situation.

    Intellectual Property:

    This refers to any patent, copyright, invention, database rights, design rights, registered design, trademark, name, business name, trade name, label, logo, service mark, utility model, unregistered domain name, or other similar rights, whether registered or unregistered, or any industrial or intellectual property right existing in any jurisdiction or region in the world.

    Online Marketer:

    This refers to a marketer to the general public through any means on the Internet, including through mobile device platforms. This definition excludes email messages, text messages, and instant messaging that do not target the general public.

    Laws:

    These refer to the laws and regulations in force in the Kingdom of Saudi Arabia.

    Agreement:

    This refers to this Terms and Conditions policy in addition to the Privacy Policy and any rules related to the use of the platform.

     

     Article 1: General Provisions and Conditions:

    1. The provisions of this agreement are subject to all applicable laws, regulations, and instructions in the Kingdom of Saudi Arabia.

     

    2. If any provision of this agreement becomes illegal, void, or unenforceable under any regulations or judicial decisions, the remaining provisions and other terms of this agreement shall remain effective, enforceable, and legal under this agreement and subject to the laws.

     

    3. You have the legal capacity and agree to comply with these terms and conditions; and you are not a minor in the jurisdiction in which you reside, or if you are a minor, you have received permission from your parents to use the website.

     

    4. You acknowledge and undertake the following:

       - All registration information you provide will be true, accurate, current, complete, and related to you, not a third party.

       - You will maintain the accuracy of this information and update this information immediately when necessary.

       - You will keep your password confidential and will be responsible for any use of your password and your account.

     

    5. If you know or suspect that any other person besides you knows your user information (such as the identification code or username) and/or password, you must notify us immediately at care@waja.sa.

     

    6. If you provide any inaccurate, untruthful, outdated, or incomplete information, we may suspend or terminate your account. We may remove or change the username you specify if we decide that this username is not appropriate.

     

    7. We reserve the right to remove any user content that you place on the platform if, in our opinion, the user content does not comply with the acceptable use policy.

     

    8. All information that we collect on this platform is subject to our privacy policy. By using this site, you agree to all the actions we take regarding your information in accordance with the privacy policy.

     

    9. These terms constitute a valid electronic contract binding on all users of the Waja Hostels platform. No party may disclaim it as long as its legal effects are produced. All subsequent amendments to these terms shall have the same legal provisions and effects as the current version.

     

    10. Any project that violates Islamic Sharia in terms of its activities or contains forbidden materials is not accepted.

     

    11. We do not provide any customer data to any party unless it is an official government entity within the Kingdom of Saudi Arabia. In the event of any dispute, we seek to reach the best solutions, recognizing that the customer is always right. If an internal resolution is not possible, the customer retains the right to pursue legal action before the competent legal authorities in the Kingdom of Saudi Arabia in accordance with the laws and terms of use.

     

    12. Waja Hostels platform commits to providing all services that help achieve customer satisfaction and fulfill all the requested needs.

     

    13. In the event of any errors in any of Waja Hostels platform systems, the platform is committed to addressing and providing necessary solutions.

     

    14. The platform is not responsible for any data loss or problems that may occur due to the misuse of the systems.

     

    15. The platform is committed to providing the necessary technical support for the various systems it offers and addressing any issues that may arise during the customer's use of these systems.

     

    Article Two: Acceptable Use

    - Use the platform only to check the availability of services and products offered on the platform to facilitate legitimate bookings or conduct business with us. Users agree to use the platform for personal, non-commercial use.

    - Use the platform's services exclusively for legitimate bookings.

    - Inform all individuals on whose behalf you will make reservations about the terms and conditions used for the booking, including all applicable rules and restrictions.

    - Do not make any fraudulent, speculative, or speculative bookings. The platform may cancel all reservations for one or multiple parties on the same date without prior notice.

    - Do not engage in any activity that could cause undue or disproportionate strain on the website, the platform, or its infrastructure.

    - It is your personal responsibility to adhere to all our specific terms and conditions, including, but not limited to, full and timely payment of all amounts due while complying with all rules regarding pricing, products, or services and all fees.

    - Do not engage in any activity that may cause harm, interfere with, disrupt access, or impair the availability of content on the website. Do not upload any files that contain computer viruses or any other codes, or software designed to intercept, destroy, or limit the platform's functionality.

    - Do not post, distribute, or upload any defamatory, offensive, abusive, harmful, threatening, offensive, misleading, or racially inappropriate materials, or any immoral or illegal content or information, or send any unwanted email, spam, or any other form of mass communication.

    - Do not threaten, harass, abuse, disrupt, or violate the rights of others, including their individual rights.

    - Do not gain or attempt to gain unauthorized access to the website or any member's account on the platform, impersonate someone else, or manipulate another person's identity.

    - Do not engage in activities that could violate or damage the intellectual property rights of the platform, any associated companies, or other parties.

    - Do not engage in any illegal activities that could create liability on the part of the Waja Hostels platform.

    - Do not violate this agreement or any applicable legislation in any way.

    - Do not upload or attach any files, programs, or other materials protected by intellectual property laws or any private or public rights.

    - Do not upload or attach files containing viruses, corrupted files, or similar software that could cause damage to another person's computer.

    - Do not remove copyright or legal notices or property labels from any uploaded file.

    - Do not advertise or offer to sell any goods or services, conduct or send surveys, contests, or email chains, or upload any file published by another user, as these methods may not be legal.

    - Do not access, monitor, or copy any content or information from this platform using any robot, spider, scraper, or other automated means or any manual process without our explicit written permission.

    - Do not violate the restrictions on the website, platform, or engage in any circumvention or any other measures to prevent or restrict access to this website.

    - Do not create deep links to any part of this platform for any purpose without our explicit written permission, or merge any part of this platform into another site without obtaining prior written permission.

    - Exempt (Waja Facilities Management Company) from liability and indemnify it for all obligations, losses, claims, expenses (including legal fees), and damages (whether direct or indirect) arising from claims resulting from your misuse of the Waja Hostels platform, including, but not limited to, claims that prove true and constitute a violation of this agreement.

     

    - If the Waja Hostels platform determines that you have violated any of these terms and conditions while using the site, it reserves the right to:

    1. Warn you that you have breached these terms and conditions and request that you cease such behavior.

     

    2. Delete any materials or content you may have posted without prior warning.

    3. Take actions, including suspension, limitation, or restriction of your access, and prohibit you from using the platform.

    4. Cancel any reservations you may have made without recourse to you.

    5. Report your activities to internet service providers or relevant authorities.

    6. Take legal action against you.

     

    Use the platform in your personal capacity or on behalf of a person whom you have the right to represent on (the Waja Hostels platform) (including but not limited to: by agency), and not to use (the Waja Hostels platform) in the capacity of any person whom you do not have the right to represent.

     

    3. Ensure the accuracy of all information entered on the Waja Hostels platform, whether it's user information or content entered for sharing or advertising on the platform.

     

    4. Do not share any information you do not have the right to publish or share.

     

    6. Take responsibility for verifying the details of any content posted on the Waja Hostels platform, confirming its accuracy, and seeking the assistance of any technical expert or obtaining legal advice before committing to any transaction. You also bear the responsibility of ensuring your actions are in good faith towards other parties.

     

    7. Pay all fees due for Waja Hostels services when they are due.

     

    8. Comply with all governmental regulations and obligations and obtain all required licenses to use Waja Hostels services.

     

    9. Do not infringe upon any other user within the Waja Hostels platform or attempt to cheat, lie, or deceive to cause harm to any other user.

     

    10. Do not use any means (including, but not limited to, attempting to hide your identity through VPN or Proxy programs) to violate the terms and conditions of the Waja Hostels platform or bypass the protective measures applied by Waja Hostels when violating the terms and conditions, to access Waja Hostels content in an unauthorized manner, or to collect information and data related to Waja Hostels or its users and utilize it in any form or republish it without permission.

     

    11. Do not engage in discussions that are unrelated to the services provided on the Waja Hostels platform, including global politics, personal matters, or other irrelevant topics.

     

    12. Do not impersonate Waja Hostels or any of its representatives, employees, or any other capacity that implies you are affiliated with it unless you have official permission from the platform.

     

    1. Attempting to explore, examine, or test the weaknesses of any of the systems or networks operated by the "Waja Hostels" platform, or penetrating any security measures or authentication.

     

    2. Engaging in any activity that may constitute a crime under applicable laws, which prohibit dealing with crime proceeds and/or financing terrorism.

     

    3. Committing tax evasion in public revenue or intentionally engaging in fraudulent tax evasion or taking steps with that purpose (or facilitating, assisting, inciting, managing, or instructing to commit such a crime).

     

    4. You are not allowed to use the "Waja Hostels" platform to develop, create, transfer, or store information that:

    • Hinders or interferes with another person's normal use of the platform or service in any way.
    • Violates privacy, threatens others, contains defamatory, harmful, obscene, or abusive content.
    • Involves fraud, forgery, or impersonation of another user.
    • The user bears all legal responsibilities in the event of any violation of intellectual property rights regarding any content posted on the platform.
    • The administration of the "Waja Hostels" platform, at its discretion, has the right to monitor the service to determine the extent of compliance with the platform's terms and operating rules. It reserves the right to remove any content that violates these terms, is illegal, unwanted, or breaches the obligations of the license grantors affiliated with the "Waja Hostels" platform.

     

    Article 5: Reservation Terms

    When a reservation is made through the "Waja Hostels" platform, you fully commit and agree to all the booking terms specific to the platform and imposed by the accommodation provider. These terms include cancellation policies, no-show policies, and any other conditions imposed on you during your stay or reservation. This also encompasses the available services and/or products provided by the accommodation provider. Additional terms and conditions may be applicable from the specific accommodation provider.

    It is a service provided on Waja Hostels that serves both the lessor, who wishes to offer their available short-term or tourist rental units, and the lessee, who is looking for units available for short-term or tourist rentals.

    The actual or legal person benefiting from hospitality services or short-term unit rentals.

    Advertisement:

    It refers to the content, information, and images provided by the lessor to describe the unit or property for rent.

    The property or space being advertised and utilized in the booking process.

    Reservation:

    Confirmation of the availability of the advertised unit according to the specified dates and terms and conditions.

    7

    Reservation Period:

    The reservation period begins at the check-in time on the first day of the reservation and ends at the check-out time on the last day of the reservation.

    8

    Booking Value:

    The total cost of all reservation days, including fees and government taxes.

     

    2. Late Arrival or No Show:

    You should contact Waja Hostels if you wish to cancel a booking (cancellable) before the booking date, at least 24 hours in advance. However, if you anticipate arriving late for the check-in time or are unable to check in on your booking day, you must contact the accommodation directly and inform them. If you fail to check in at the accommodation on your booking day without notifying them, the remaining period of your reservation may be canceled, and you may not be entitled to a refund of your money, according to the terms and conditions specific to the accommodation.

     

    3. Change or Cancellation of Booking:

    The cancellation policy varies between accommodations. Some bookings are non-changeable or non-refundable, and some accommodations may impose certain fees on cancellations. However, others allow for a full refund of the booking amount. Please note that some bookings at specific rates or special offers may not be eligible for changes or cancellations. The change or cancellation policy for the accommodation can be found on the information page of the accommodation on the platform, under "Booking Conditions," "Cancellation Policy," or similar sections, as well as in the electronic booking confirmation message. We recommend reviewing and understanding the cancellation and no-show policies of the accommodation before completing the booking.

     

    Regardless of the accommodation's booking change or cancellation policy, Waja Hostels reserves the right to impose certain fees on booking changes or cancellations, as specified on the website. If you wish to review, modify, or cancel your reservation, please refer to the electronic booking confirmation message and follow the provided instructions or contact Waja Hostels customer service team.

     

    Any request for cancellation or modification must be sent to us through our contact methods, and it will be considered from the day of receipt, provided it complies with the following conditions:

    - The reservation can be canceled or modified up to 24 hours before the check-in time.

    - Cancellations and modifications are not allowed after entering paid bookings. The amount will be deposited into the wallet or the bank account, depending on the customer's preference.

    - The refund duration depends on the bank account following the bank's policy and procedures, and it may take up to 15 business days from the date of the claim.

     

    Cancellation Policy:

    The customer has the right to cancel an order before receiving it into their accounts.

    If the payment was made using a credit card or another non-cash payment method, the refund will be processed within 7 business days, with customer service and training fees deducted.

    4- When using the daily booking service on Waja Hostels, you understand and agree to the following:

     

    - Waja Hostels' role in this service is limited to facilitating the booking process, collecting the transaction amount from the renter, and delivering it to the lessor after the booking period ends in accordance with the service's terms.

     

    - The relationship between Waja Hostels, the lessor, and the renter is that of independent parties. This relationship does not constitute a partnership, employment, or agency relationship between any of them. Waja Hostels has no responsibility or control over how the lessor manages any offered unit or how the renter utilizes any reserved unit.

     

    5. When attempting to book or completing a booking for any unit offered in the service as a renter, you acknowledge and commit to the following:

     

    - You have reviewed the specifications and requirements of the unit and agreed to them when booking it.

     

    - You commit to paying the full value of the booking period.

     

    - You agree to the cancellation and refund policy specified by the lessor in case you wish to cancel the reservation after it is made.

     

    - You will behave responsibly while staying in the reserved unit and not misuse or abuse any of its facilities.

     

    - You grant the lessor the right to verify your identity against the ID used during the booking process before enabling you to use the unit and deny you access if there is no match.

     

    - You release Waja Hostels from liability if no complaint regarding the booking is made after the booking period ends for 48 hours.

     

     

    6- When offering or making any unit available for booking through the service as a lessor, you agree and commit to the following:

     

    - Complying with all relevant laws, regulations, and legislation and obtaining all required regulatory licenses and permits for the lessor or the unit. You must have the legal capacity and eligibility to offer and lease the unit and bear the consequences of any violation of these terms.

     

    - Ensuring the accuracy of all information about the offered unit on the Waja Hostels platform and confirming it is true (including, but not limited to: photos, availability, prices, services, facility descriptions, check-in and check-out times, and any unit-specific requirements or restrictions) and committing to keeping this information up to date.

     

    - Not modifying any of the unit's features after it is booked (until the booking period ends) without the renter's consent.

     

    - When confirming any booking, this confirmation constitutes a contract between you and the renter to enable the renter to use the unit and its facilities according to the terms, specifications, and prices offered throughout the booking period.

     

    - Not imposing any terms or conditions on the renter that contradict these terms, and committing to include any requirements or conditions in the unit's advertisement that the renter must comply with.

     

    - Authorizing the Waja Hostels platform to collect the unit's booking value when reserved by any renter (in addition to any fees, taxes, or governmental charges applicable to the transactions) to your registered account with the platform after the booking period ends according to the payment schedule, provided there are no complaints from the renter related to the booking.

     

    - Waja Hostels may impose a compensation fee for any booking that the renter cannot benefit from due to the lessor's actions (including but not limited to: your cancellation, enabling another party to book the unit during the same period, having a defect in the unit, or having a substantial discrepancy from the provided information). You also waive your right to the booking value according to the following details:

     

    1. If the booking is canceled within 48 hours or less before the start of the booking or after the booking period has started, the compensation value will be 50% of the booking value for the unused days.

     

    2. If the booking is canceled before 48 hours and up to 30 days before the start of the booking period, the compensation value will be 25% of the booking value.

     

    3. If the booking is canceled before 30 days before the start of the booking period, the compensation value will be 10% of the booking value.

     

    4. The compensation value for each booking should not be less than 250 Saudi Riyals and should not exceed 5,000 Saudi Riyals, regardless of the booking value.

     

    7- Payments

    We may offer paid products and/or services within the service. In this case, we use external services to process payments (such as payment processors). We will not store or collect your payment card details. This information is provided directly to external payment processors, whose use of your personal information is subject to their own privacy policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, a joint effort by brands like Visa, Mastercard, American Express, and Discover. PCI-DSS requirements help ensure the secure processing of payment information.

     

    8- Refund Policy:

    • First Payment: The initial payment cannot be refunded after subscription confirmation, and any additional funds will be refunded after the expiration of the trial period for the first payment.

    • You can contact customer service to identify and resolve any issues and determine whether you are eligible for a refund. Customer service staff use specific service policies and legal requirements and may be able to refund the amounts you have paid.

    • The customer is obligated to pay service fees after reaching an agreement with customer service after registration and the end of the trial and training period.

    • Renewal: The customer is obligated to renew at the due date of the invoice, and the customer will be notified of the renewal date one week before the end of the usage period.

    • We do not assume any responsibility for any errors in financial transfers or bank deposits.

    • When depositing money into our accounts, you must inform the accounts department to confirm the deposit within a period of no more than 72 hours.

    • We provide browsing and platform usage services for free without the need for platform subscription or payment for browsing and shopping our digital products.

    • Value-added tax may be imposed on the products we provide through the platform, and therefore, the customer is obliged to pay the tax value within the sales invoice issued to them.

    • Fees are charged for platform hosting services purchased through us, and the customer is responsible for these fees to ensure the continuous operation of the platform.

    • The customer must check the prices listed on the platform they wish to purchase, and the customer knows that these prices are final and cannot be reduced under any circumstances unless the platform offers specific promotions, which will be clearly announced on the platform.

    • The platform accepts payment in our accepted local currency or in US dollars, and we have the right to specify certain currencies for sales for some orders.

    • Payment for platform services is made through our approved payment methods, which are displayed to the customer during the payment process. We may change our approved payment methods at any time or request specific payment methods.

    • The customer acknowledges that the electronic payment gateway imposes fees related to the payment process, and the customer bears these fees without any responsibility on the platform. The electronic payment gateway also imposes its own terms for service provision, which the customer must adhere to.

    • You are aware and agree that the platform is not a payment card insurer and does not retain the customer's payment data. Therefore, the customer must be cautious during the payment process, paying directly through the platform without using any intermediary software or pages to ensure the safety of their payment methods.

    • Payments may be processed by banks and electronic payment service providers to ensure that the transactions are legal and do not involve any suspicious or fraudulent activities.

    • The platform has the right to modify and update this payment policy at any time as deemed appropriate, and the modification and update will be made according to our vision.

    • When you make a payment for any service on the platform of Waja Hostels, you acknowledge and agree to the following:

    1. The platform has the right to refuse any refund request for any amount after payment (including, but not limited to: packages, upgrades, promotions, subscriptions, and fees), except in the following cases:

    1. Reservations in the daily booking service are governed by the cancellation policy of the reserved unit.

    2. You can request transferring advertisement packages to another user within (5) days of the payment date.

    2. Refund of paid amounts will take 14 working days after the refund request is approved.

    3. When requesting a refund of any paid amount, you agree to bear any fees incurred by Waja Hostels for the refund (including, but not limited to: transfer fees or payment gateway fees).

    • Summary of Failed Payments:

    - Payments on the platform may fail for various reasons. In such cases, Waja Hostels will provide you with alternatives, if available, to complete the booking. If you have any questions, please contact the customer service department.

     

    Booking Terms and Conditions

    • Check-in time is 3:00 PM, and check-out time is 1:00 PM.

    • Many accommodations have specific policies regarding children, companions, or traveling with pets. It is strongly recommended to check with customer service or the accommodation itself for their specific policies.

    • If you have special requirements (e.g., an accessible room), you must contact customer service or the accommodation to confirm that these special needs can be met. Please note that special requests are subject to availability and are not guaranteed. If the accommodation cannot meet your special needs, your booking may be subject to refund, cancellation, or modification in accordance with the accommodation's policy. If available, your special request will be confirmed upon arrival. Waja Hostels will not be held responsible for any damages or costs incurred if the accommodation cannot fulfill your special needs.

    • When you make advance payments for your bookings with Waja Hostels, it means you authorize Waja Hostels to use your information and process it, through external parties, in a way that allows us or your payment method issuer (e.g., credit card or debit card) to verify your identity.

    • To complete the payment of prepaid accommodation bookings with Waja Hostels or related companies, you authorize Waja Hostels to charge the full amount from your chosen payment methods (sometimes without a refund option, subject to accommodation booking terms, please see below) upon booking and confirmation. Or in the case of the "Book Now, Pay Later" option, at a future time specified in the electronic confirmation. When using "Book Now, Pay Later" bookings, please ensure the validity of your payment method and that you have sufficient funds on the specified date for the payment. If the required amount is not available at the specified payment date for any reason, the booking will be canceled, except if you confirm that the amount will be available at the payment date. Waja Hostels or related companies will process refunds, if necessary, within a reasonable timeframe. You also authorize the deposit in your payment method in the event of refund operations, settlements, or reimbursements or modifications during the service, facilitating financial transactions. For some accommodations, Waja Hostels will not charge your payment methods as you will pay directly at the accommodation (Pay Later). However, in some cases, some accommodations may pre-verify your card, and either a pre-authorization or the full booking amount may be deducted. Accommodations may require credit card information to guarantee your booking. Therefore, Waja Hostels will send the payment method information you provided directly to the booked accommodation and may pre-charge an amount from this method as well. To protect and encrypt your payment method information when sending it to us, some selected payment method companies impose a processing fee for foreign transactions. If your card transaction is to a bank in a country different from the country of your card issuer, and similarly for the recipient, a fee for international transactions, cross-border transactions, or similar fees may be added. Your card issuer may or may not impose this fee. Please contact your card issuer for details, as this part is not under the control of Waja Hostels.

    • In case of fraud using the selected payment method or unauthorized use by others, you should contact your bank or card issuer immediately upon becoming aware of such unauthorized usage. If you suspect unauthorized or fraudulent bookings through Waja Hostels, please contact our customer service team immediately.

    • To make any booking, you must be over 18 years of age (or the legal age in those countries where the legal age is higher than 18) and have full legal capacity to transact (or have a legal guardian's authorization). You undertake that your payment method is yours or that you are authorized to complete the booking using this payment method and that there are sufficient funds to cover the transaction's cost. You accept financial responsibility for all transactions made under your name or account.

    • You also undertake that the payment details you provide to us when making any booking are entirely accurate. Waja Hostels retains the right not to accept certain payment methods. Waja Hostels may add or remove other payment methods at its discretion. Waja Hostels now provides the option to store your payment method details securely to facilitate bookings. If you choose to store a credit or debit card with Waja Hostels, we may not request verification of the card or security code the next time you use it to make a booking. For further details, please refer to our privacy policy.

    • We apply strict mechanisms to detect and prevent fraud. In specific cases, we may request additional information or verifications to authenticate and confirm the booking in greater detail, as explained more in the website. Pre-authorization or a booking amount may also be deducted from your card in the event of booking or use of "Book Now, Pay Later" at a later date. If you choose not to provide additional information or if we are not satisfied with the information received, the booking will be canceled as incomplete, and any amounts (including verification fees where applicable) will be refunded.

     

      • Rights of the Tenant:

     

    At Waja Hostels, we always prioritize the comfort and rights of our guests. Here are the rights of the tenant:

     

    • If the tenant finds the residential unit not clean upon check-in, they have the right, after contacting the customer service team, to request a free cleaning service immediately, to be completed within a maximum of 3 working hours.

     

    • If the tenant experiences any type of disturbance or noise during their stay with Waja Hostels due to external noise (e.g., ongoing construction work), they have the right, after contacting the customer service team, to request a transfer to another residential unit with the same specifications and the cost already paid, provided a unit is available.

     

    • If the tenant wishes to request additional amenities such as extra wardrobe space, they can communicate with the customer service team and request their needs, subject to payment of fees if these amenities can be provided.

     

    • If the tenant finds that one of the basic requirements is not available in the residential unit, such as bathing essentials, towels, or an ironing table, they have the right, after contacting the customer service team, to receive their needs without any additional charges.

     

    • If the tenant wishes to extend their stay, please contact the customer service team at least 24 hours before the check-out time to ensure the availability of the residential unit. If there is another customer booking, the tenant must check out at the scheduled time.

     

      • Rights of the Platform:

     

    Waja Hostels has certain rights to maintain the proper functioning of the platform and protect the interests of the host and other guests:

     

    • Hosting parties and disturbing other tenants will result in legal actions, and Waja Hostels has the right to immediately evict the guest.

     

    • Parking should be done in designated areas.

     

    • Any damage to the residential unit and its furnishings will result in the guest being charged for the cost of repairs or replacements.

     

    • Waja Hostels is not responsible for any lost items after check-out.

     

    • Delays in paying the due amounts after extending the stay may result in eviction of the tenant at any time until payment is made.

     

    • Tenants are required to comply with the operational and usage guidelines. In cases where guidelines are not available, please contact the customer service team.

     

    • Smoking cigarettes or shisha is prohibited in residential units. Violation of this rule may result in a fine. However, there are some units where smoking is allowed, and you can confirm this by contacting the customer service team.

     

    Article 7: Preventive Measures

    In the pursuit of enhancing the service quality provided to its users and in accordance with your use of these terms and conditions, you agree to grant Waja Hostels the right to take any of the following actions without prior notice if it determines that you have violated the terms and conditions agreement of Waja Hostels:

     

    1. Suspend your membership and temporarily or permanently ban you from using all or any of the services provided by Waja Hostels, with the right to withhold any prepaid services compensation.

     

    2. Delete all or any of the materials or content posted by the user on the Waja Hostels platform.

     

    3. Report your activities to the relevant authorities.

     

    4. Take any legal actions against you.

     

    Article 8: Limitation of Liability and Disclaimers

    As a condition for using this platform and website, you agree to absolve us and indemnify us against all claims, liabilities, losses, suits, expenses (including legal fees), and damages (whether direct or indirect) that arise from claims related to your use of this platform, including but not limited to claims that prove to be true and constitute a violation of this agreement on your part.

     

    All contents, including software, products, services, information, text, graphics, or related materials contained in or available through the platform are provided on an "as is" and "as available" basis. Waja Hostels does not provide any warranties or representations of any kind, whether express or implied, with respect to the operation of this electronic platform or the information, content, or materials contained in this electronic platform. To the maximum extent permitted by applicable law, Waja Hostels disclaims all warranties and representations of any kind, whether express or implied, including, for example, implied warranties of merchantability, satisfactory effort, informational content, ownership, or non-infringement of third-party rights. Waja Hostels does not warrant or represent that the platform will operate without errors or interruptions, that errors will be corrected, or that the platform or its servers will be free of viruses and/or other harmful components. Waja Hostels does not warrant or represent sustainability, availability, accuracy, reliability, completeness, or updating of any materials of any kind contained in the platform for any purpose, including but not limited to software, products, services, information, text, and related content.

     

    Waja Hostels is not responsible for any intentional error or gross negligence, and it shall not be responsible for failures resulting from server faults, misleading transfers, redirected communication interruptions, interrupted reservation transmissions, or any computer viruses, or other technical disruptions, whether human or technical in nature.

     

    The limitations of liability mentioned above do not allow the restriction or exemption of liability in accordance with the relevant laws. In this case, Waja Hostels shall assume responsibility to the extent specified by the relevant laws.

     

     

     

    Article 12: General Liability

     

    To the extent permitted by law, the platform or related companies, under any circumstances, including their managers, representatives, subsidiaries, affiliates, employees, suppliers, licensors, agents, or any other parties involved in providing, guaranteeing, promoting, or facilitating the platform and its content (collectively referred to as "Covered Parties"), shall not be liable to any person or entity for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, or any other damages or losses, including but not limited to:

     

    1. Loss of production, loss of profits, loss of revenues, loss of contracts, or loss or damage to reputation, image, or goodwill, or intangible losses.

    2. Your inability to use or unauthorized use, delay, or non-operation of the platform.

    3. Unauthorized access to or manipulation of personal information or transmitted data.

    4. Provision or failure to provide any service, including services provided or products offered by the place of residence, cancellations (partial), or overbooking beyond the stated capacity.

    5. Errors or inaccurate data on the platform, including information (descriptive) (including but not limited to rates, availability, and classifications) about the place of residence as made available on the site, and related software, products, services, and graphics obtained through the platform.

    6. Any transactions conducted through the platform.

    7. Any property damage, including damage to your computer system or device resulting from viruses or other harmful elements during or due to access to or use of the platform or any site linked to it.

    8. Any other damages arising from the use of the platform or any use, delay, or inability to use the platform, or any information, products, or services obtained through the platform.

    9. Any personal injury, death, property damage, or other damages caused by the place of residence (its employees, managers, officials, agents, representatives, or affiliated companies).

    10. Any other damages resulting from an event of force majeure. The limitations of liability apply regardless of the form of action, whether based on contract, tort, negligence, strict liability, or otherwise, even if the covered party has been advised of the possibility of damages.

     

    A force majeure event is any event beyond the reasonable control of the covered parties and may include, but is not limited to, natural disasters, weather conditions, fires, nuclear accidents, electromagnetic disturbances, acts of terrorism, riots, wars, deliberate fires, rebellion, disobedience, armed hostile acts of any kind, labor disputes, facility closures, strikes, shortages, or governmental actions, embezzlement, bankruptcy, machine breakdowns, quarantine, network or system failures or collapses, communication or internet disruptions, epidemics, disease outbreaks, and the like. The covered parties shall not be liable for any additional expenses, errors, delays, rerouting, or actions by any government authority. No covered party shall be liable for any violation by the place of residence of any term or warranty, including but not limited to, fitness for a particular purpose or merchantability, and no covered party shall be liable for any other errors by the place of residence (including any negligence) in relation to any products and/or services available through the site. The platform cannot guarantee uninterrupted access to the site.

     

    The platform, and J&A Hostels, shall bear the liability as provided by the applicable laws in case of deliberate misconduct or gross negligence in the provision of related services. To the extent permitted by applicable laws, and without prejudice to the limitations set out in the terms of use, the total liability of the platform and J&A Hostels will not exceed the lesser of (A) the total cost of your reservation as specified in the electronic confirmation message (whether for one event or a series of related events) or (B) two hundred and fifty US dollars (or its equivalent in the local currency). In the case of doubled or erroneous charges made by J&A Hostels, the customer may claim all the incorrect fees, despite the foregoing.

     

    Moreover, the liability mentioned above cannot be restricted or exempted from according to the relevant applicable laws. In this case, the platform and J&A Hostels bear the liability to the extent prescribed by the applicable laws. Claims should be submitted as soon as possible after.

     

    8. The platform is provided "as is and as available," without making any representations or warranties of any kind, whether implied or express, regarding the use of this platform, its content, or the materials found on it.

     

    9. You explicitly agree that you use the platform at your own risk. You acknowledge that we are not responsible for the quality and legality of products and their information, which are the sole responsibility of the customer. Therefore, we disclaim our liability, and you agree to this regarding violations by customers or any other parties of any obligations imposed on them under the agreement concluded between them.

     

    10. The platform does not provide any guarantees that this platform, its servers, or email sent from it will be free of viruses or other harmful components. Furthermore, the platform does not provide any guarantees that defects will be corrected, and it may not be available from time to time due to maintenance, repair, or development. You explicitly agree that the platform is not obligated to provide technical support for the platform.

     

    11. The platform is not legally responsible for any losses or damages of any kind that arise from using this platform, including, but not limited to, direct, indirect, incidental, and consequential damages.

The nature of the internet means the platform may be subject to data corruption, interception, unavailability, or delays.

    22. You absolve the platform from any legal liability arising from the cessation of the platform due to your non-payment of hosting service fees or delayed payment. You also acknowledge that hosting services are provided through third parties, and you absolve us in the event of temporary service cessation due to service provider faults or data transfer from one host to another or other factors beyond our control.

     

    23. The company, its subsidiaries, licensees, service providers, employees, agents, officials, and directors will not, under any circumstances, be liable for any damages of any kind arising from or related to your use or inability to use the website, other linked sites, the content on those other sites, or any services or goods obtained from the platform of those other sites.
